1. Introduction
   These general contractual terms are part of the contract between you and DIREKT HOLIDAYS.
2. Registration, contractual agreement and terms of payment
   You can book your choice by telephone or via mail with DIREKT HOLIDAYS. You will immediately receive your confirmation of reservation from us. 50% of the rental sum are to be paid up front within 28 days. The rest of the payment is to be payed at arrival at the latest. The contract between you and DIREKT HOLIDAYS is finalised with your up-front payment.  If no up-front payment is received within 28 days, DIREKT HOLIDAYS is free to make any decision it wishes concerning business around the object of potential choice. With reservations at short notice (less than 29 days) before start of the letting period the entire rent sum is to be payed at once and the agreement is finalised hereby. If rest payment is not made within the stated period (respective the entire sum for short notice reservations) DIREKT HOLIDAYS can deny service. You will receive the coupon after your payment of the up-front sum. Our bookings department is only allowed to accept special wishes from your side on a non-committal basis. Compliance with those wishes is not legally binding, except when these have been confirmed by DIREKT HOLIDAYS in writing. DIREKT HOLIDAYS asks for an administrative fee of 20€ for each reservation.
3. Service and prices
   The published prices are weekend prices for the entire rental object in the respective rental period. When there are several appartments of equal worth in a house, with an equal number of rooms and an equal capacity and equal prices, then these are marked with a respective number. (for example: 3+). In such a case the catalogue and the price list will only list the first of such an appartment type. Minor deviations in the description are possible as are differences for special offers within the same type. The minimum rental period normally lies at 7 days. Arrival and departure day are Saturdays (high season). Exceptions are possible with the consent of the bookings department  in writing. Prices do not include additional expenses. Additional expenses are listed in the confirmation writing. If this is not the case, the sum is given. This sum, together with the rental price will be payable. Visitors tax is to be payed locally. Not included and payable locally are additional services asked for such as additional laundry services, bed linen, towels, etc. In appartments that offer internet access, the free offering of service does not constitute a claim for depreciation if the necessary signal can not be received (for whatever reason). The infrastructure (transport modes, shops, restaurants, etc.) announced in the prospectus, in the confirmation and in the other documents are not part of the contract and do not constitute an obligation on part of DIREKT HOLIDAYS. These services decide themselves concerning their hours of service, etc. The same can be said of the public services (water, electricity). Also any information concerning the weather are no assurances.
4. Changes of service and/or of prices
   The descriptions and price calculations were compiled with care. Changes of service and/or of prices, that take effect before your reservation, are communicated to you with your booking or at the latest with the confirmation of your booking. Should differneces arise between the printed price lists or the catalogue and the booking confirmation, then the confirmation takes the lead.
5. Arrival and departure; change of duration of stay
   The arrival should happen between 1400 and 1800. Departure before 1000. Should you arrive later than 1800 the DIREKT HOLIDAYS is to be informed of this in advance. Should you not be able to take on the object as agreed, for example because of high traffic, strikes, etc. or personal reasons then the entire rental price is to be payed. The same applies should you leave early. If you wish to lengthen your stay then please arrange this as early as possible with the booking department.
6. Cancellation of contract on your behalf
   In respect to a cancellation or a change in booking after finalisation of the contract and before the beginning of your stay, DIREKT HOLIDAYS is permitted to calculate the following cancellation charges (in %): up to 43 days before stay = 10%, up to 29 days before stay = 50%, up to 20 days before stay = 80%. Cancellations after the 19th day before the stay mean that the full price is to be payed. Decisive is the arrival of your notice in the booking department (for Sundays or bank holidays the next working day counts). Every cancellation costs 40€. We advise you to book a annulation guarantee with your booking. This guarantee covers the cancellation costs as a consequence of sickness, accident, death of the hirer, co-travellers or of close relatives (doctoral note necessary). A annulation guarantee can be booked online on our homepage (www.direktholidays.at).
7. Substitutional rental objects and cancellation of contract by DIREKT HOLIDAYS
   DIREKT HOLIDAYS can, should unforseeable circumstances arise, offer substitutional rental objects of equal worth. DIREKT HOLIDAYS is permitted to cancel the contract before or during the rental period should unforseeable circumstances make the offer of the rental object impossible, endanger the hirers or the rental object itself or decrease the quality of service to an extent that is not acceptible. Payed sums will be reimbursed (under consideration of any delivered performance).
8. Obligations of the hirer
   Only the communicated sum of people (children included) are eligible within any rental object. Additional people can be sent away or can be calculated seperately locally by the key holder. The rental objects are to be treated with care. Hereby attention is to be paid not to disturb the neighbours and other parties. Cleaning of the kitchen, of dished and cutlery lies in the responsibility of the hirer (and not included in the final cleaning). Should the hirer (or co-hirers) cause any damages then these are to be communicated immediately to the key holder. The hirer is liable for any such damages, except if the hirer can prove lack of fault. The same is true if the appartment can not be handed over to the next hirer. Pets are to be registered at the time of booking (partially pets are not allowed in the rental objects).
9. COMPLAINTS
   Should the object not be in a contractually described state or should you experience damages then this is to be immediately communicated to the key holder.
10. Liability of DIREKT HOLIDAYS
    Should the rental object not be in line with the contract, then DIREKT HOLIDAYS will make every effort to offer you a object of equal worth. Should this not be possible within the agreed time frame or should you object to the offer due to important reasons then DIREKT HOLIDAYS will pay you an appropriate sum to make up for the decreased value. This is only the case however if DIREKT HOLIDAYS is in any way to blame. Should any form of damage arise for you due to DIREKT HOLIDAYS breaching the contract then DIREKT HOLIDAYS is liable for damages. The legal liability for circumstances other than damages to people (for example damages to objects) is limited to double the rental price (whereby the demands of all involved parties are added). Should the damage be traceable to any of the following reasons then DIREKT HOLIDAYS is not liable:
11. a. Actions or withholding of such on your behalf or of another user
    b. unforseeable or inevitable failures of third parties, that are not involved in the fulfillment of contractual obligations.
    c. Higher powers or events that DIREKT HOLIDAYS, as the intermediator or benefit deliverer (for example as key holder) could not have foreseen or avoided in spite of all care taken.
    d. Damages or losses as a result of burglary
    
    These terms are valid for liabilities outside the contractual agreement in analogy. Liabilities for benefit deliverers or assisting individuals are hereby excluded. International agreements and national laws with wide ranging liability limitations or exclusions supersede.
12. Jurisdiction
    The relationship between you and DIREKT HOLIDAYS is governed by austrian law. The customer can only make legal claims against DIREKT HOLIDAYS in the local county court. DIREKT HOLIDAYS is permitted to make claims against the customer in their place of residence or in the local county court. The mediation of the holiday object through us happens in the name of and for billing of DIREKT HOLIDAYS.
